Laws Entered into Force

05.05.2026 – Legal Updates

In its decision of 28 October 2025 (B 28.10.2025, 09 CG.2025.136), the 3rd Senate of the Princely High Court held that, in the case of a private-benefit foundation not entered in the commercial register, an incomplete foundation deed constitutes grounds for dissolution if the defect concerns one of the three essential elements of the foundation establishment transaction. The existence of grounds for dissolution leads to the annulment of the foundation in nullity proceedings and thus to its dissolution with effect from now.
